Information Duty Energy Conservation
Establishments covered by the Activities Decree must comply with information requirements by December 1, 2023
On January 1, 2019, the energy savings information obligation for companies and institutions went into effect, with a deadline for compliance of July 1, 2019. The information obligation means that every company and institution must perform a quick scan to determine whether it falls under the energy savings obligation.
A company/institution subject to this obligation must submit a report to the competent authority showing which energy-saving measures have been taken and which measures can still be implemented. The starting point is a list of recognized measures.
Voor alle andere ondernemers, dus ook voor gebouweigenaren, gelden vanaf 1 januari 2024 nieuw regels voor de Informatieplicht. Onder de Omgevingswet zal een onderscheid worden gemaakt in de regelgeving voor gebouwgebonden maatregelen en procesmaatregelen. In het Besluit bouwwerken leefomgeving (Bbl) zijn de regels vastgelegd die gaan gelden voor de energiebesparende maatregelen die zien op gebouwen. De daarin opgenomen informatieplicht zal gaan gelden voor de gebouweigenaar (artikel 3.84a lid 1 Bbl). De regels over de energiebesparende procesmaatregelen zullen zijn vastgelegd in het Besluit activiteiten leefomgeving (Bal). De daarin opgenomen informatieplicht zal blijven gelden voor de ondernemers zelf (artikel 5.15a lid 1 Bal).

What does the energy conservation information requirement mean?
The 2017 National Energy Outlook (NEV) revealed that several energy and climate goals will not be met by 2020. One conclusion is that the competent authority has insufficient information for targeted monitoring of, and enforcement of, energy conservation requirements. The introduction of the information obligation aims to speed up the provision of information to then be able to enforce information in a targeted manner.
When must the Duty to Disclose be met?
Effective January 1, 2019, the submission deadline is July 1, 2019. According to future Section 2.15(2) of the Activities Decree, a new report must be submitted once every four years. For companies covered by the Activities Decree, they must no later than December 1, 2023 comply with the information requirement.
As the name implies, the obligation to provide information is not voluntary. When the duty to disclose is not met, the competent authority can enforce, such as by imposing a penalty.
Energy label A++ or A+++
Does your building, depending on its use function, have energy label A++ or A+++ or better? Then you comply with the proposed final legal standard (Renovation Standard) for utility buildings in 2050. You indicate this in your disclosure report. For all building measures, the system automatically fills in "fully implemented.
